retirement and remarriage

Married 1971, divorced 1997. remarried same 2003. Spouse retired 3/06. Company refusing to release retirement funds until we go back to court and petition to have divorce overturned since they were ordered to split all funds at the time of retirement. Is this right? If so, do we need to hire an attorney or just go to clerk of courts to file a petition?

This is not the time to be a "do it yourselfer".

Seek an experienced family law attorney, preferrably someone board-certified. Definitely someone with significant experience handling "Qualified Domestic Relations Orders" (QDRO, pronounced "quah droh").

He/she will be excited to see a couple not fighting. Because you reunited and are doing this amicably it will cost much less than if you were fighting to divide it.
