Separtate Property

I inheritied land as separate property while married. We built a home on the land. Is the land now community property?

No, but you probably owe your ex for his/her share of the community assets that went into the improvements.

Re: Separtate Property

The land remains separate and the house is community. Since the house is permanently attached to the land, you would owe your spouse 1/2 value of the house and 1/2 the increased value of the land that the community property was responsible for. Kind of complicated, but on the other hand, the court could rule you donated 1/2 of the property to your spouse by building the house on it to begin with.
