Your son will have to file suit to establish paternity but until some award of custody is given there is little that can be done to stop her from leaving the state.

How does he know he is the father? Just because she says so and he had sex with her, means nothing until DNA is done. It can be done now safely. Pay for it to be done and if he is the father, then he has some say.....however, if she protests, then she will be saying he is not the father and cannot be forced to submit to the testing. It also brings up a whole lot of issues. As the potential grandmother, I am sure you are concerned. But in 38 years of practice, it is always the girlfriend, or new wife or mother or grandmother who asks questions here about a male who has or may be the father of, a child. If he does not care enough to write, you need to back off. You are setting yourself up for heartache and for financial responsibilities that you may not be ready for. Grandparents really have very few rights.
