Not getting to see my son

Me and my sons mom was never married. I just started seeing him last year when I found out about him. We went to court over custody and I got every other weekend and rotate holidays. I've been dating the same girl for over two years and we're getting married just haven't set a date. Last weekend was supposed to be my weekend and when I called to see where to go get my son she told me she didn't wont him around my girlfriend. She--name removed--never had a problem until now. We've lived together the whole time and now she trying to keep my son from me. Can she do that? Need help on what to do...Brian

I believe she can demand that when your son visits you, that no female not related to you can the night. The same would apply to her having an unrelated male spend the night when she has the child. My suggestion is either you stay with your son somewhere other than where you and your girlfriend lives, or have the girlfriend move out when the boy visits....of course you could marry her and settle all issues.

I suggest you have an attorney review the judgment that established your visitation rights. What that court order says is the most important factor in determining what you can or cannot do.

Of course, if you marry your girlfriend the mother loses any standing to object.

Wife my have waived objection

There is also the fact that your wife allowed it to happen for two years before objecting and only when you wanted to marry did she object.

Your wife has the right ot object but she may have given that right up by not objecting sooner. Speak to an attorney to review the full facts and the court order.
