Legal Question in Family Law in Louisiana

Me and my sons dad had custody and child support papers drawn up at the end of june of 2008 at the beg of august of 08 my sons dad was involved in a boating accident and suffered brain damage so he know collects disability and my son gets social security. His family pays me nothing out of pocket and only sees my son 3-4 days a month because they don't like to come pick him up, now my son's dad's mom is trying to claim my son on taxes because in the agreement it said we would go back and forth every year but since they never see him and pay no money for him is that possible for them to do? Also they never followed through on the custody agreement after it was drawn up so wouldn't that cancel everything in the agreement?

You need to return to court and have the agreement amended.
