Legal Question in Family Law in Louisiana

If in the state of Louisiana if a married couple with 2 children the ages of 7 and 1 are having marital problems, she wants him to move out what should he do to keep his rights. thanks! denise

Unless he believes a reconciliation is reasonably possible, he should consult an attorney. There are too many variables for any one answer.

I agree with Mr. Casanave and would ask what rights are he wanting to keep? If the wife files for divorce she can request he be forced to move out so she and the kids have a place to stay. He would "lose no rights" by moving out, either voluntarily or by court order. They would still have to remain physically separated for at least 1 year before they could ask for a judgment of divorce unless there was another ground that would allow a divorce sooner.
