Legal Question in Family Law in Louisiana

stepparents rights

My husband and i live in Va and his kids live there in Lake Charles w/there mother(cp). I was told the the courts in La does not take the stepparents relationship with kids in consideration when determining what is in the best interest of the child(ren)? I guess when and if one of the parents have remarried and do the courts consider this as a hardship when determining child support? bottom line is does the courts or the judge look at the relationship with a step-parent?

Courts, whether in Louisiana or in Virginia, will

always take into consideration in some measure the relationship that a child(ren) may have with

his stepparent in determining what is in the child(ren's)best interests.

A stepparent's relationship with their spouse's children are always considered in determining what is in the best interest of the children. As far as the hardship part of the question, I think what you are asking is does the court consider the new marriage and its added expenses in determining child support? The answer is no, as it should be. The child's support is the primary concern. Because adults break up and incur added financial responsibility should not be passed on to the innocent ones in the situation.
