Legal Question in Family Law in Louisiana

Taking child out of state away from father

My son's ex-wife has a new boyfriend and is planning on taking my 6 year old grandson to Houston, TX away from all of his family. They currently live in Louisiana. What can we do to stop her? He will have no one there but his mother.

Re: Taking child out of state away from father

Under Louisiana Revised Statutes Title 9 section 355.3 and following, the mother must give notice of the move to your son by sending him a certified letter at least 60 days prior to the move, or 10 days after finding out the where the move will be to. He then has 30 days to object. My advice is that he file a rule to prevent the move and ask for the domiciliary status of the children without waiting for formal notice. Moving because of a job change is not sufficient reason, especially if the child has roots, friends and relatives in the area he is moving from.
