Temporary custody by Mandate

A young birthmom, who is unrelated

to us, has asked my husband and

me to take temporary guardianship

of her 3y.o. child. She lives in

Louisiana, we live in Arkansas. Is

ICPC necessary and do we need to

retain an attorney or can we do this

amongst ourselves with notary

signatures?

The birth mother can give any person a provisional custody by mandate that is good for one year. After the year, it can be renewed for another year.

However, the birth mother is entitled to revoke the mandate at any time for any reason.

I agree with what Mr. Lougue wrote, but since you mentioned ICPC, it made me think that there was more to this. If the mother is being supervised by the Louisiana Department of Social Services, then she cannot give custody to anyone without court approval. Otherwise she can.
