terminating parental rights

I just found my daughters father after 10 years of searching. I asked him to terminate his rights. He agreed would I have to get a lawyer to do this. I know how to do the forms and can do myself. Do we have to actually show up in court for this to take place?Does someone have to adopt her like her stepfathe in order for this to take place. Thanks

Dear LawGuru Friend,

I have been practicing law for almost 40 years in Louisiana, yet there is a lot I do not know about it. However, based on what I do know, I feel that the only way a father can terminate (give up) his rights to a child he has fathered and can prove he has fathered is to actually surrender the child for purposes of adoption; and, even then, within a reasonable time the adoption should follow. Of course, a father can take steps to give someone else custody, or even tutorship, of his child; but such can always be changed and/or revoked in some cases. The only way that the father just flat loses all rights to the child is to surrender the child for adoption, and for the adoption to take place within a reasonable time. That's just one lawyer's opinion. May be some other lawyer with more knowledge of so-called family law than I have who will tell you differently. Best of luck!
