Legal Question in Family Law in Louisiana

termination of mothers rights

My husband has full custody of his son with the mom only having supervised visitation for 4 hours everyother weekend. She is presently in jail and will be on supervised probation for the next three years. She was arrested for doing crack in the presence of the child in question. She is now a convited felon. If she screws up and goes to jail for the three years is it possible to terminate her rights. I want to adopt him and put an end to his nightmare dealing with a mom that is not respondsible, nor concerned about the child best interest? Is this possible?

Re: termination of mothers rights

It is possible under certain circumstances if she does not visit with her child or support him for a certain time period.

However, you must make sure you do not prevent her from seeing her child. If you prevent her from seeing her child, you would not be able to terminate her rights.
