Legal Question in Family Law in Louisiana
My thirteen year old no longer wants to reside with his mother and her live-in boyfriend.I believe in the state of Louisiana he is old enough to decide where he wants to live.His school work and emotional health are being effected.She refuses aknowlegde that he has a choice.She is even trying to get him put in a bootcamp program so that she does not have todeal with him.What can I do?

File a motion to alter the custody and visitation order. The Court will take the child's wishes into account as ONE factor, but the child still can't just choose where he wants to live. The Court will make the decision based on what it sees as the best interests of the child. Also, look at your custody and visitation judgment. There is likely an order in there stating that neither party is to have overnight guests of the opposite sex in the home with the child. A live-in boyfriend likely violates the Court's judgment to begin with and your ex could probably be held in contempt of court for that.
