I'm unemployed due to company lay offs, & soon will be going in for child support modification. Will my support increase or will the judge grant the non custodial parent request to decrease support?

Child support is based on the incomes of both parents. The amount of support will remain the same unless there is a substantial change in circumstances. There needs to be at least a 25% increase or decrease in the earnings. The mother's income is not taken into account if the child is under 5 and the mother is the custodial parent. If one parent is unemployed through no fault of their own, an income will be assigned to them in the calculation of support. Minimum wage is often the figure assigned.
