Legal Question in Family Law in Louisiana

visitation before judgement

I have been in a relationship with a man for 6 yrs, engaged for 2yrs. We have a 12mth old son together. I have recently discovered lots of infidelity on his part and informed him that I was moving out. I have retained an attorneys service, and she has drafted custody papers, but has yet to file them. I offered for him to have his son this weekend, and he agreed. I am good about letting him know what is going on with him, illnesses and such. He has never been a caregiver to our son so I am worried about this weekend. My question is... what if he doesn't want to return him on Sunday. Do I have any legal rights to demand him returned?

If there is no custody order he has as much right as you to simply take the child away. I would wait until I had a custody order signed by a judge.
