Legal Question in Family Law in Louisiana

Visitation Rights Denial

What can I do to get my children when I am being denied my visitation rights? I live in Texas, 3 hours away from my kids, and they are in Louisiana. I am being denied to bring them to Texas or to visit my family and my fiance's family in Louisiana. What can I do? I have a disabled child at home so I am unemployed. It would be hard, but I can get the means to support my children. What can I do to retain full custody back of my children. They are, son age 12, daughter age 10. Son lives with ex-husband and daughter with ex-inlaws. Neither ex will let me visit my kids without them sitting in the same room. I do not have restricted visitation rights. My 12 yr old son wants to live with me.

Help!!! What can I do and where do I start????

Re: Visitation Rights Denial

If your final order was in Louisiana, you will have to begin there.

I suggest you conduct a search to find an attorney in Louisiana that handles that type of case.

It will be difficult to conduct a contested custody case that far away, but it is not impossible.

Use lawyers.com or divorcesource.com

Just a thought.

Good luck.

Re: Visitation Rights Denial

Start with your current visitation order. What are the rules? If you don't have a certified copy, buy one from the Clerk of Court in the parish where the order was issued.

If the order says you can have overnight visits, then demand them, even if you need the police or sheriff to help you enforce the order. They will obey your certified copy. Don't let these people force you to have less visitation than the Court has given you.

Contact a lawyer near where the kids live and discuss your strategy.
