What exactly does a wife have when she is deserted by her husband?

Question 1: What property is hers when husband leaves no forwarding information?

Question 2: What kind of settlement does she get?

Question 3: Isn't it desertion when husband leaves and doesn't try to contact the wife and has been gone, since Sept 01.

In Louisiana a wife is entitled to one half of the community property, i.e. any property obtained during the marriage. Her settlement should be half the assets, less half the debts. In La. if a married couple stays separated for more than 6 months, either party can sue the other for divorce. We no longer use desertion as grounds for divorce.

The wife should contact a lawyer immediately to protect her interests. He may be creating debt for the community during all of this.

1. An attorney can help with the divorce and the property, half of everything is hers.

2. If he's gone, she's in control.

3. Desertion is a nice word but has no legal bearing on the divorce and the property.
