The mortgage company controls whether your wife's name will be removed from the mortgage, not the ex-husband. I assume she has a judgment partitioning the community property, with him getting the house and agreeing to be solely responsible for the mortgage. While that is binding between your wife and her ex, it is not binding on the mortgage company. If he fails to pay, they will look to her for payment. If she does not have a judgment dividing the community, she should get one.
