Legal Question in Family Law in Louisiana
My ex wife and I have a 9 year old daughter. She lives with her mother in texas and I live in Louisiana. I just moved here 6 months ago. Back when I lived in Texas My ex wouldnt let me see my daughter very often and I heard that she had gotten suspended from school, cursed the teacher out and was completely out of control, throwing desks and what not. She has been kicked out of daycare and preschools, She been in an alternative school, keep in mind she was around 4-8 when this was happening. This was happeneing while in her mothers care.
When she did get to spend time with my wife and I She would tell us that Her mom wouldnt ever pay attention to her very much, she'd make her go out and play or to her room..as she couldnt be bothered by her or something. She also has 2 sons that are from a prev. marriage and one lives in a home due to severe mental problems and the other she told her ex husband to come pick him up right now or she was going to literally drop him off on the side of the road for someone else to come get and the boys father can vrify that 100%. She doesnt have a stable job and often complains she doesnt have any money, She just seems very unstable to me andmy wife and we want to try to get custody of my daughter because we beleve she would do alot better with us. We are more financially sound and We have the actual time to spend with her. I am just afraid that her behavior is getting out of control because her mother doesnt take proper care of her..what chance do we have or getting custody of her

In Louisiana it is presumed that joint custody is in the child's best interest. Sole custody will be granted if you can show that the other parent is not providing a stable, safe and wholesome environment.
