Legal Question in Family Law in Louisiana

a Wife's rights

If I marry a man who is wealthy and well established without a prenuptual agreement and the marriage ends in the death of him, do I come into half of our entire estate?

I am engaged to such a man who has grown three grown children. His wife died and he is now in the process of doing a sucession.

Please advise.

Re: a Wife's rights

You do not come into ownership of any property that he brings into the marriage. You only have a right to one-half of the property acquired by the two of you during the existance of the community between you. That is, once married, all income of his is 1/2 yours and vice versa. However, at his death, the community ends and you own 1/2 of all community property, and 1/2 of any income being produced by "community property." This is a very simplistic explanation of your rights without knowing any particulars. I strongly suggest that if you are worried about being left penniless if he should die, you seek the advice of an attorney or at the very least make sure there is a good life policy in full force and effect.
