I am not a FMLA expert, but my understanding is that you are covered by the FMLA for depression so long as it has been diagnosed by your treating psychiatrist, who has also stated that you are unable to work due to the illness.
Know, however, that your employer does NOT have to pay you under the FMLA after your sick and annual leave is exhausted. The employer does have to keep your position available to you upon your return, but he does not have to pay you after your leave is used up.
