Legal Question in Civil Litigation in Louisiana
I am 42 and I was molested by one my brother growing up until the age of around 14. My mother knew about it never did anything. The only proof I have that this took place is that I testified to it in an appeal hearing to get another one of my brother's death sentence reduced to a life sentence. The other is a letter my mother wrote to me on 9/2/2010. Stating to me that she didn't understand why i was bringing up the past b/c we were kids when that happened. I have tried to kill myself more than once. I stayed a week in a mental hospital about 4 years ago. I am on my 3rd marriage and I still have problems. My brother in prison was abused as a child severely and b/c he was never gotten any help he eventually flipped and killed a 9 year old boy behind a church. And possibly more. My mother died on 5/17/2011 and the brother that molested me is making my life a living hell. I need to know if it is too late to sue him and or press criminal charges against him? I hope this time I gave enough information for someone to answer.

For criminal prosecution it is 30 years from the date the victim becomes 18. For civil cases it is 1 year from the date the victim turns 18 or discovers the crime. The latter would indicate a repressed memory, etc.
