How to answer, Request For Admission

Hello,

My ex broke into my home about 4 years ago and stole various items. I filed a civil suit to protect myself, and the state has a crimminal suit as well. I have received a ''Request For Admission'' from her attorney with questions with no relevance to the case.

1. How should I answer these questions.

2. What is the process in returning the request, Do I need to file it in the court, Send it directly back to her atty, What forms do I need (as in affidivit, certificate of service) or what?

Please give me some info as I cannot afford an atty at this time. I need to try to do this myself.

First, if you consider the question irrelevant, then your answer may be, "The question is irrelevant."

Second, as to how to reply, the normal question is how did you receive the request? Rather than give a detailed response as to how to file, I would suggest the safest way. File your answers in the suit record (with the clerk of court) and mail a copy by certified mail, return receipt, to her lawyer. The green card will be your proof that the lawyer received it plus there will be no question that you responded if the response is in the public record.

Remember, you only have a few days from delivery of the request to respond, so attend to it immediately.

You only have a certain number of days to answer the request for admissions!!!!! If you fail to answer them within the time delays, all answers are considered by law to be in favor of the person making the request. So, be careful, if you do not answer some or all of the requests, then they will be answered for you by law.
