Falling Tree Incident

Is there any cap on the dollar amount that a private individual can file a suite on in small claims court?

I am looking at approxmately $20K. If there is a limit, what are my options going forward? What and how does the process work?

The damages cap in Texas Small Claims is $5,000.00 plus costs and interest. One penny over, and the Court loses jurisdiction.

I've no idea what the situation may be in Louisiana.

Although there is some variability between parishes in Louisiana, 20 thousand is substantially above the ceiling for any small claims court in the state.

If the case is worth 20k, it's worth hiring a lawyer.

If you believe your claim is $20,000, then hire an attorney, because your opponent certainly will.

In Baton Rouge, La. the jurisdicitonal limit of our small claims court is $3,000.00. I concur with the recomendation that you obtain the services of an attorney if you feel you have a $20,000.00 claim.
