hit and run

my car was involved in a hit and run parked in my yard around 4:30 in the morning. The insurance of the other car will not pay my claim because the driver at the time of the car didnot have permission but the car was not reported stolen what are my rights. what can i do? thank you for your time. Contact a lawyer immediately. Since you already have communicated with the insurer, you have spent time on the case. There are time limits after which you lose your rights.
