Legal Question in Civil Litigation in Louisiana

incorporating or not

Do I need to incorporate to protect myself personally or will I be protected if I just use my company name? I contract with people to haul trailers for me. Thanks

Re: incorporating or not

Using the scant facts you provided, you are doing business as your company name. In other words, it is JOHN DOE d/b/a TRAILER HAULING COMPANY. You are personally liable unless there is another "person" who is liable. A corporation or LLC is another legal "person." So, incorporate or form an LLC.

I agree with Mr. Pizzolatto, and I think an LLC is probably a better choice for you.
