Legal Question in Civil Litigation in Louisiana
Okay, this question pertains to a question I asked before. The question pertains to an 18 wheeler in which one party and I made a written agreement, stating that I was to buy the truck in the amount of $10,000 with a thousand dollars a week until paid in full. The problem is, I have no money trail for the money I paid him but as the paper states, that the last payment, of a thousand dollars was received on january 16,2009 seven days before I was incarcerated for 27 months. Now if the paper states that the last payment was received on a certain date and I have no paper trail, then how can there be a last payment without having a first, second, third, etc. Would you please be able to enlighten me on this situation.
your help is appreciated,
Otis

It is certainly a piece of evidence. You will have to prove to the Court "clearly and convincingly" that you were buying the vehicle in installments and that title should now pass to you. You may have a criminal action for theft of the funds if you have evidence that you were defrauded.
