Legal Question in Civil Litigation in Louisiana
ordered a new motor for my 1987 mazda B2600 4x4 at autozone last summer. have 3 year warrenty. Truck has been a nightmare ever since. after a never ending repair to the vehicle i started to do some research for repair option. Found out that even though the year, make, model, model # and vin number were given to autozone to order the engine I was sent the wrong engine. Aside from the $2000 dollars for the engine I have probably spent an aditional $1000-$1500 at auto zone buying other parts that don't fit because I was sent the wrong motor. In my research I found that during that year mazda did not make a 4wd engine and outsourced the manufacturing of that engine to mitsubishi. The factor specs for an 87 b26004x4 had a 4 cylinder mitusbishi engine while the 2wd model had a ford/chrystler engine(the one i was sent). Even thought the engine is still under warrenty the store manager has not given me much hope of a return or exchange of this porduct. Cost included are engine, parts, and labor that have put me in a financial bind and rendered me without transporation and inevitably jobless.
1 Answer from Attorneys
You may have to file suit to get your new engine and damages. You can file in small claims court for any amount under $5,000.00 (in a justice of the peace court) and under $3,000 (in a city court), depending on where you live. You don't need an attorney to file suit in small claims court. You can get a service address for Auto Zone from the Louisiana Secretary of State. They have an online database of corporations' registered agents for service of process.
