my partner is being sued for terroristic threat, following a criminal charge of the same after the criminal charge was dismissed. Do we have recourse?

Civil matters and criminal matters are different and not mutually exclusive. The burden of proof is different. Criminal matters require proof beyond a reasonable doubt while civil matters require clear and convincing evidence or a preponderance of the evidence.
