Legal Question in Civil Litigation in Louisiana

i own a piece of property with a tree that lies on the property line between me and my neighbor. The water oak is 3/4 on my property. The neighbor refuses to allow us to cut tree down. Without cutting tree down i can not build my house. What are my rights? and Can my neighbor sue me if tree dies while building my house?

I would cut down the tree. It is interfering with the use and enjoyment of your property and it is primarily on your property. There are articles in the civil code directly relating to trees located on property boundaries. If you don't want to hire a lawyer, you should at least go to the library and look up the code articles on the topic.
