Legal Question in Civil Litigation in Louisiana
I am asking this question for a family member. we are in louisiana.
Early Sunday morning around 3:45 am he got in a fight with another man at a local club they were asked to leave as they were leaving he was yelling at the other man, The police came and grabbed him, him not knowing who was grabbing him he jurked away , so he was charged with resisting an officer and public drunkness, the only thing he had wrong with him before the police arrived was a black eye. the police slung him to the ground and he remembers one hit to the head and then he blacked out, he didnt regain conciousness for about 6-7 hours when he woke up he had been badly beaten on his head and had road rash all over him from where it appears he was dragged across concrete, When he woke up he was just now realizing he was in jail, the guard told him that the police roughed him up once he was already in jail, so that means he was unconcious. He had to go to the er and had a bad concussion. Is this police brutlality? should this be on video of the arrest and once he got to jail would it be on camera? Would he have a case? Thanks

Some jails have video and if it exists, it can be subpoenaed. You should make a complaint to the sheriff or police chief. The problem is that he has no memory. You will need thevideo or witnesses to be able to prove what transpired.
