Legal Question in Civil Litigation in Louisiana
Because of Rita, rent is going up , can we do anything about it?
We moved to Bayou Villa apartment on 7-27-04. I was told that the rent will never go up here. When we moved $430 dollars was already high for us. Then came Rita, we had to stay out of here for a whole month because of the flood. We lost one month of wages. Coming back we had to live with the mold that came from downstairs. I have 2 children and my 8 years old child is always sick. We stay because we did not have anywhere to go. Now we just received a plain notice in our door that read: ''As March 1st 2006 will have a rent increase, your monthly rent will be $500.00.'' I called everywhere for help including kplctv news and the mayor's office. Can you give me any help? I really appreciate any help I can get on this. Thank you.

If there is a written lease setting the amount of rent, then the landlord is bound by that agreement. Otherwise you will have difficulty proving this guarantee not to raise the rent.
