CAN i FILE CIVIL SUIT EVEN THOUGH I PLEAD GUILTY? I am a doctor that plead guilty because they charged my wife with the same counts as myself. We were prepared for trial when 3 days before I was told that the prosecutor had evidence that showed we had billed for services that were never rendered and that my wife that billed it could be in trouble if I didnt plea. After I plead, we were presented with a summary that showed 16 patients that it said were billed for various things that were never performed. When we received the transcripts that went with the summary, we found that State Farm had lied in the summary and that all sixteen patient transcripts said the opposite of the summary. I tried to change my plea and was denied. I was convicted and served six months. We now know that I was maliciously convicted using a fraudulent document produced by State Farm while they threatened my wife. I am on a short time line because June 23rd will be one year from my ssentencing hearing.

You should speak to the district attorney concerning the crimes committed against you. You could also speak to the attorney generals office. You may have a tort action against state farm and I suggest speaking to a personal injury attorney prior to the years prescriptive period ending.
