Legal Question in Immigration Law in Louisiana
misdemeanor, OPT international
I am an international student working in US on my OPT. I have recently been charged with a misdemeanor on ''reckless operation of a vehicle'' for driving on the wrong side of the road. This is what happened: It was late, raining and I could not see the divider (my first time on that road), such that I ended up on the wrong way. In less than 10 seconds a police car was in front of me! Nothing happened, as I have not hit anything. I actually stopped suddenly, while seeing the police car with the lights on in front of me! They took me to the police station, took my fingerprints and photos. They asked if I was drinking. I had to say yes, one beer. No sobriety test was taken, and no DUI was issued.
They set up a court date in August. My OPT expires in September. I was planning to leave the country late June (I will have to, as I need to start working in July) and eventually return In October or November on a different visa (B1/B2). I know that this unfortunate incident changed the look on my plans considerably. I have no way of sorting this problem out.
Could you please tell me what to do? How will this affect a new visa approval and eventually a future entry in the US? Any suggestions would be more than appreciated. Thank you.

This misdemenor will not affect you. Why are you going back? You should find a non-profit emplyer who can sponsor your H1b. Some of the non-profits are not subject to quota.
