Amissions of Affidavits from previous court cases?
I am currently in litigation with my supplemental disability company for denial of benefits and for being arbitrary and caprious in handling of all disability claims. I was able to find an affidavit of a former physician who worked for the insurance company which gives explicit testimony of the ways almost all claims were denied in a previous trial. I am currently going for summary judgement and the judge is not willing to admit the affidavit and feels my attorney should locate this physician and take the affidavit again. Is there any cases where affidavits from previous cases were admitted in a new trial? If so please inform!
