Legal Question in Insurance Law in Louisiana

Pregnant and changing jobs/insurances

I am currently pregnant and have health insurance through my current employer. I am considering changing jobs, therefore changing insurance providers. Will the new insurance through my new employer have to pay for the remainder of my pregnancy/delivery even though it was a pre-existing condition? Is this a bad idea--should I just wait until the baby is born and HOPE to find another job like the one I have been offered?

Re: Pregnant and changing jobs/insurances

Dear LawGuru Friend,

Insurance is a contract, and whatever the contract says, that's what applies; unless, of course, the contract (policy) provides for something not allowed by the law of insurance and/or contracts. Here you would just have to contact the administrator of each of the two group plans and ask whether or not you will be covered by one, or possibly both, of the policies after you make your job change; and, if so, which one or ones. My guess is that for sure you would not be covered by both, but you need to check in advance to make sure that you do not find yourself in a position of not being covered by either. Someone inside both companies can direct you to the person or persons having responsibility for these group insurance plans who can answer your questiion, according to the terms of the said policy or policies. Sorry I cannot give you a more definitive answer, but you should be able to find it on your own. You are doing the right thing, and that is checking in advance of making a change. Good luck to you!

Sincerely,

Hardy Parkerson, Atty.
