Legal Question in Intellectual Property in Louisiana
I manage a business incubator (help entrepreneurs and small businesses) and have a new client who wants to sell dolls on the Internet. To make the dolls the client plans to use fabric that has sport teams' trademarked logos, such as the "Saints," "Dallas Cowboys," etc. printed on them. I assume that the fabric manufacturers have paid a license to the teams to use their logos. However, I am not clear as to whether the license can apply if the fabric is used to manufacture items for sale by a third party. Can anyone help give me an answere I can share with my client? P.S. the business services we provide our clients through the business incubator are provided at no charge to the client. We are a nonprofit economic development organization whose purpose is to diversify our area's economy and help create new jobs.

Any attorney will say, don't assume anything. The logos on the fabric may be unauthorized; not necessarily the fault of the fabric company - they may not know about trademark infringement, etc. Your best course of action is to contact the various teams and get permission for using their logos on the dolls. Consult with an attorney in your area for specifics.
