Legal Question in Employment Law in Louisiana

My anniversary date with my company was July 19th. I had earned 3 weeks vacation from working last July through this July. Now the company is resetting all vacation to 0 hrs this Nov. 11st. And we will start accumulating vacation time each pay period. What about the 3 weeks I already earned from last year? They are taking it away from us. Is that legal for them to do that? Thank you

It depends on what the vacation policy says. Once vacation is "earned," it can't be forfeited. However, a company can institute a "use it or lose it" policy which means if vacation isn't used by a certain time period, it is lost. In my opinion, the company has to give you a reasonable time to take the vacation though. Ultimately, the wording of the policy is most important and I would have to see that language in order to give you a more definitive answer.
