Legal Question in Employment Law in Louisiana
Can a company decline you for employment for a misdemeanor charge even if it's been sealed for a year? I was charged with a misdeameanor theft charge of $97 from Target in 2003. I have since graduated with a degree in Communications and have not had any other brushes with the law. I have contacted the city court, state court, and national and local FBI offices and even Lexis Nexis and they all say that my record is coming up clean, yet I keep getting turned down for jobs that I meet the requirements for. What can I do? The clerk at city court suggested I contact each individual employment background agency, but that could take months. Please help!

You can move to have the charge expunged, not just sealed. Talk to a criminal lawyer in your area. They can move to expunge the record.
And, to answer your first question, yes the prospective employer can refuse to hire you for that.
