Legal Question in Employment Law in Louisiana

Can one company stop be from becoming employed by a different company?

I worked for company (A) for over a year. Company (A) sold many of their stores to company (B). I worked in one of the stores that was sold. Company (B) offered me employment but I declined it because I didn't wish to work for them. I have applied for employment back with company (A) but first they have to get company (B) to release me first of company (A) will be pentalized because of terms of the sale. I never worked for company (B) and I didn't sign anything that said I would not go back to work for company (A). So my question is, can company (B) refuse to release me and keep me from being employed again with company (A) Is there laws in Louisiana that protects the employee from such a thing?

This is a more complicated issue than simply can B do it. I must assume you worked in management or some similar position other than an hourly position, since it would be those positions that B would want to retain and not let A take from them. If this is the case, you may have agreed sometime in the past not to work for a competitor if you ever left A and that agreement may now be enforced by B. However, all the above is conjecture, but makes some sense to me under the circumstances presented. If I am correct, B would probably release you if you went to work for A in a store not in competition with one of B's stores. Seek out an attorney in your area specializing in employment law.
