Legal Question in Employment Law in Louisiana
Within the confines of a contractual employment, is libel, slander, defamation pertinent to a legal action. Or, is the fact that the contractual company blanket covers that and negate its efficacy?
I.E. I was called an inflammatory name by one of my supervisors. It led to my eventual, short term dismissal from the company. I am an older person, 65, and it seems we older employees are targeted. I am presently on a worker's comp claim with the same company.
Technically, I was angered by the remark and can elaborate.

You can sue for defamation that occurs in the workplace. However, your facts show a possible more serious cause of action. If a company is "targeting" older employees for termination, that is a specific violation of the law. Companies cannot discriminate based on age. You may want to consider bringing this case to the EEOC. You have strict deadlines to follow to do this, however, so you need to act quickly if you want to pursue that avenue.
You do not need an attorney to bring a complaint to the EEOC, but you will want one if you intend to sue for damage for age discrimination in court. Filing with the EEOC is a prerequisite to bringing a lawsuit in court.
