Legal Question in Employment Law in Louisiana
I contacted HR this week regarding a series of events that have transpired with my manager and began the process for STD. Later that day I was contacted by my manger and HR and interogated about falsification of documents. The claims are ridiculous and this event is taking place a week before a hiring blitz next week. Following the call I completed the process for STDon 10/28 and began STD 10/29. I was informed that FMLA was denied. I have only been wtih this company for 10 months. HR tried to contact me on 10/29. They left a message that they needed to speak with me. I received a message that I should expect overnight package. My question: I understand that not being eligible for FMLA they can terminate my position. However, does that prevent me from receiving STD benefits? If I receive a package do I refuse it on open it?

Short term disability depends on company policy and is not a guaranteed right.
An FMLAeligible employee is an employee who has been employed by the employer for a least 12 months and worked at least 1,250 hours. The 12 months do not need to be consecutive. You are only an eligible employee if your employer employs 50 or more employees within 75 miles of the worksite.
