Legal Question in Employment Law in Louisiana

Foul language in the work place

My employer and other co-worker are always using foul words in office. Is there something I can do about it?

Thank you

Re: Foul language in the work place

Dear LawGuru Friend,

Thanks for the question! Sorry about your unfortunate situation on the job! Yes, you can do something about it. I once knew an old boy who worked out on the grounds crew for the City of Lake Charles. His fellow workers were always cursing on the job and in his presence. So he started singing hymns as he worked. To make a long story short, this got him fired. He filed a complaint with the Equal Employment Opportunities Commission and won his case. He got back pay, and, as I recall it, his job back. Before you file a complaint, however, you might want to discuss the situation with your boss. However, if you do, there is a chance that he will decide that you are trouble waiting to happen, and you will be fired. Of course, if that happens, you still have a case for the E.E.O.C.. Nevertheless, you would have a stronger one if you filed your complaint while still working there. I am sure there is something in the law that says that the employer can't discipline nor discriminate against you simply because you have lodged an E.E.O.C. complaint. Go on line and look up E.E.O.C. and see what you can learn. Study what you find there and you will know more about E.E.O.C. than most lawyers. Feel free to contact me if I can be of further assistance. Best of luck!

Sincerely,
