Legal Question in Employment Law in Louisiana

My husband works for a Louisiana company that is behind paying all the employees by 2 pay periods. They were promised to be paid on the first and fifteenth of every month, on the thirtieth they will be behind 3 pay periods. Because of the nature of the business (video game) and the lack of specialized jobs in our area, most of the employees have no other options but to stay. What can they do legally to get paid? They all signed a contract to work there and they have employment guidelines that included when they were to be paid.

Dear Law Guru Friend,

This is a very peculiar legal problem that you have. Nevertheless,

assuming that your hustand wants to keep that job in the future, he

should kindly and gently go to the head payroll clerk or person and

make an inquiry as to what the reason is for the non-payment in the

usual manner and hope and pray that this matter will be taken care of

soon and that things will get back to normal for the company/employeer.

On the other hand, if your husband is at the point of leaving this

employment and seeking other employment, he can just give notice

of his intention to quit and then quit; and then by law they must pay

him off within twenty-four, hours of his written demand upon them for

his wages then due , in default of which, his wages keep running for

up to ninety (90) days; and he can then sue for his wages due at the

time of his qutting, for his penalty wages due and for his attorney's

fees necessary for him to collect his regular and penalty wages due him.

There is much more to it all than this, but this is something to

consider. If you would like, you can e-mail me your phone

number and name, and I will call you and discuss this matter

further with you at no chage. Why no charge? Well, I am at least

temporarily retired from law pracitce, and I no longer charge for what

I do to help people with their legal problems.

Sincerely,

Hardy Parkerson, J.D.
