is it legal to take register shortage out of paycheck

It is a common practice. I have never personally seen it challenged in a court, but I would assume it would be upheld, as the server who rings up short is obviously the one responsible for any shortage in the drawer. Even though the employee did not intentionally lose the money, it was their responsibility to exchange the money correctly and I think a court would uphold the company's right to reimbursement. Besides, if you challenge it, you will certainly lose your job. In this market, you should be careful about taking actions that could lose you your job. Fighting over a few dollars in your drawer is not worth losing your job over.
