Legal Question in Employment Law in Louisiana
Piecework and overtime wages
I work in a warehouse/Production facility operating a machine that makes a product called Silt Fence, used in the construction industry. When I do my regular warehouse duties I am paid at a rate of 8.25 pr/hr.I am paid time and a half for any hours past 40 in a week. When I work the production I am paid at a piecework rate of $.45 per roll of Silt Fence. To make the same as my hourly rate I must produce about 150 rolls of Silt Fence a day. I then can stay and make more Silt Fence but the rate doesn't increase at all. I feel that I am being cheated out of overtime pay when I work production. Am I being unfairly paid?

Re: Piecework and overtime wages
Unless you are in an exempt position, which it does not appear since you are paid OT in the warehouse, then you are entitled to OT.
