i have been with this particular company for nursing home health for 2 years of my 15 year nursing career. a new director of nursing was hired who then in turn after 1 month of her employ terminated my employment without any notice and i was told to leave that day afteer my day of work. am i eligable for a payout of my accumulated earned pto's which are paid time off hours. there are no specifics in the manual regarding sick or vacation hours, it is just labeled pto's. thank you c. ward

According to Louisiana's Wage Payment Statute, you are entitled, upon termination of employment, to all "earned" wages. The question in your case is whether your PTO is considered "earned." That normally depends on the policy of the particular employer, however, in your case, because there is nothing in the employee manual, it would probably be a question of prior practice and how the company treated that time. My guess is that you should be entitled to some payout, but I would need to know more about the facts to be certain. Consider speaking to an attorney.

Does PTO mean paid time off?? If so, and you "earn" so many hours according to how long you work, then you probably are entitled....it is similar to unused vacation....
