Legal Question in Employment Law in Louisiana
Sick Days Subtracted From Vacation Days
I am on salary, which includes 2 weeks paid vacation, all holidays off, one Friday off each month and sick leave is paid. I asked permission to take my two weeks vacation in October. At that time I was informed that I had only one week of vacation left. I have not taken a vacation at all this year. Asked the reason why, he said I was off sixteen days this year already. Only been off 9 days, 7 days sick with doctor's excuse, 2 days for death in family. I have been off work other days, due to the employer closing office on those days. Can the Employer subtract sick or other misc. days from vacation days?

Yes, but only if it is part of your employment handbook or contract, and then in only special circumstances. Vacation is 'earned' and as such is considered just like a paycheck. Louisiana courts are very protective of employee's wages.

Probably, but it depends on your employer's policies and past practices. The real problem is that you don't have an real remedy, aside from making a complaint to your boss, unless you leave your employment.
