Legal Question in Employment Law in Louisiana

I signed a noncompete with a company that sells gutter overhangs. I do not work with them anymore. Can my husband start a gutter company using the info I gathered from my previous job with my former employee?

He can start it, but do not be surprised if the old company sues to stop him.

The noncompete clause does not apply to him at all, so he can start the new company. However, if he uses any of your insider knowledge of any of this company's trade secrets or customers, you could be sued for that.

Also, noncompete clauses are not favored under Louisiana law and they are often invalidated. You may want to have an attorney review your noncompete agreement to see if you can have it thrown out.
