I am a tenured teacher of 20 yrs in Louisiana. I have been allegedly charged by 2 staff members of false profanity used in dialogue with them in the presence of students. I am on administrative leave waiting for a decision. I am interested in charges based upon slander of my name, and harassment by my principal.

In order to win a suit for defamation, it would be up to you to prove that someone else made a false statement about you to another person and that the false statement caused you injury. Clearly, you can prove the second two elements (communication to another person and injury to your career and reputation), but you must also prove that the charge was false. That may not be easy, as it is hard to prove a negative (e.g., it is easy to prove that someone said something, but it is hard to prove that someone did NOT say something). Moreover, there are limited (but not absolute) privileges for things that people say in court and in adminstrative proceedings (e.g., when testifying).
