Legal Question in Employment Law in Louisiana
today i went to file my w2 form from my former employer, a mexican restaurant in West Monroe, Louisiana. The tax preparer informed me that from filing this w2, I would have to pay the IRS around the amount of 500.00. This is absolutely not possible. I was working there as a waitress. I have seen in the past when I was employed there that some of the hispanic employees were getting paid with checks with american people's names on it. Iam almost certain that this has happened to me also and I have been a victim for a year if not more than that. I need to know the steps I need to take because this is a very serious matter.

If you truly believe this company has committed this fraud, you should report them to the IRS and the local police (in West Monroe). Your tax preparer should be able to help you with contacting the correct department within the IRS. Either way, you can't just ignore it. The company is going to send that W-2 to the IRS and if you don't inform the IRS that you have been the victim of fraud, they will assume it is correct and that you owe the IRS money. In that instance, if you fail to pay on those taxes, they will rack up interest and penalties against you and it will likely haunt you for years. You would be well advised to get out in front of this now.
